Yes Chefo1. Acceptance of these terms
These Terms of Service ("Terms") are a binding agreement between you and [NE RESTAURANT LTD] ("Yes Chefo", "we", "us"), registered in [Ireland]. By accessing or using the Yes Chefo website or product (the "Services") you agree to these Terms. If you do not agree, do not use the Services.
2. The Services
Yes Chefo provides AI-assisted kitchen and menu tools for hospitality professionals, offered under the plans Home Plus, Develop, Operate and Brigade. Features and plans may change over time. Some features are provided free (including limited previews) and some require a paid subscription.
3. Accounts
You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 and able to form a binding contract. Notify us promptly of any unauthorised use.
4. Plans & billing
- Paid plans are billed in advance on a recurring basis (monthly unless stated otherwise) through our payment processor, Stripe.
- Prices are shown at the point of purchase and are in the currency displayed (euro, €, unless stated). Applicable taxes may be added.
- By subscribing you authorise us (via Stripe) to charge your payment method for each renewal until you cancel.
- We may change prices; we will give reasonable notice, and changes apply from your next billing period.
5. Free trials
Where a plan offers a free trial, it converts to a paid subscription at the end of the trial unless you cancel beforehand. You may cancel at any time during the trial to avoid being charged.
6. Cancellation & refunds
You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. Except where required by law, payments are non-refundable and we do not provide refunds for partial periods. Your statutory rights as a consumer, where they apply, are not affected.
7. Acceptable use
You agree not to:
- use the Services unlawfully or in breach of these Terms;
- attempt to disrupt, overload, reverse-engineer, scrape or bypass rate limits or security;
- resell or redistribute the Services or outputs except as permitted by your plan;
- submit unlawful, infringing or harmful content, or another person's personal or confidential data without a lawful basis;
- misuse AI features to generate unlawful, misleading or harmful material.
8. Your content
You keep ownership of the content you submit ("Your Content"). You grant us a limited licence to host, process and transmit Your Content solely to operate and improve the Services and to generate the outputs you request (including sending it to AI providers as described in our Privacy Policy). You are responsible for Your Content and confirm you have the right to submit it.
9. AI-generated outputs
The Services use AI to generate menus, dishes, costings and briefs. Outputs are provided for professional assistance only and may contain errors or inaccuracies — including in figures such as gross profit, costings, allergens and nutritional content. You are responsible for reviewing and verifying all outputs before relying on them commercially or operationally. Yes Chefo does not provide legal, financial, food-safety or nutritional advice. Nothing generated should be treated as a substitute for professional judgement or regulatory compliance.
10. Our intellectual property
The Services, including software, design, branding, the Yes Chefo name and logo, are owned by us or our licensors and protected by law. Except for the rights expressly granted to use the Services, no rights are transferred to you.
11. Availability
We aim to keep the Services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, with reasonable notice where practical.
12. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Yes Chefo will not be liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill arising from your use of the Services. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses arising from your misuse of the Services, Your Content, or your breach of these Terms.
15. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or to protect the Services or other users. On termination, your right to use the Services ends; clauses that by their nature should survive will survive.
16. Governing law
These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you in your country of residence.
17. Changes to these terms
We may update these Terms from time to time. We will update the "last updated" date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
